LIABILITY WAIVER & RELEASE FORM
GALI STUDIOS - 2782425 ONTARIO INC.
This Liability Waiver & Release Form (“Agreement”) applies to all clients, participants, guests, and visitors participating in or attending photography services provided by 2782425 Ontario Inc., operating as Gali Studios (“Gali Studios”).
By booking a session, attending a session, or checking the acceptance box, you confirm that you have read, understood, and agree to be bound by this Agreement.
SERVICES PROVIDED:
Gali Studios specializes in providing a range of photography services which include, but are not limited to:
Family photos
Children/Baby photos
Maternity photos
Gali Studios provides professional photography services, including but not limited to family, children/baby, and maternity photography sessions.
RISKS ACKNOWLEDGEMENT:
All photography sessions have inherent risks which may result in personal injury. While Gali Studios takes reasonable precautions to ensure a safe environment, there is no assurance of absolute safety.
For children and pregnant women, the risks might include but are not limited to:
Accidental tripping or falling
Props or equipment malfunctions
Unforeseen health issues or reactions
It is crucial to understand these risks before participating in any photography session. The Client acknowledges that photography sessions involve inherent risks, including but not limited to personal injury, property damage, or unforeseen incidents. Despite reasonable safety precautions, risks may arise due to environmental conditions, equipment, props, movement, or participant behavior.
For children and pregnant participants, risks may include, but are not limited to, tripping, falling, interaction with equipment or props, and unforeseen physical reactions.
The Client voluntarily assumes all such risks.
SAFETY EFFORTS AND LIMITATIONS:
Gali Studios puts forth every effort to ensure a secure environment for all participants. However, absolute safety cannot be guaranteed. We invest in quality equipment, periodic reviews of safety measures, and professional training for our staff. Yet, situations can arise that are unpredictable.
It remains the responsibility of each participant or their guardians to assess personal health risks and make an informed decision about their participation in the services offered by Gali Studios.
PARENTAL SUPERVISION:
Parents or guardians are wholly responsible for the safety, behavior, and well-being of their children during any session with Gali Studios. This includes children who may not be direct participants in the photography session. Any individual under the age of 18 must be accompanied and supervised by a parent or guardian at all times. Parents or legal guardians are solely responsible for the supervision, safety, and conduct of all minors at all times. Gali Studios is not responsible for supervising children, including those not actively being photographed.
WAIVER & RELEASE OF LIABILITY:
By agreeing and checking the box, the participant, or parent/guardian of the participant if under 18:
Acknowledges that they have read and understood the risks associated with the services provided by Gali Studios.
Releases and discharges 2782425 ONTARIO INC. operating as Gali Studios, its employees, agents, representatives, and any associated entities from any and all liabilities, claims, demands, actions, causes of actions, costs, and expenses of any nature whatsoever arising out of any loss, damage, or injury, including death, that may be sustained by the participant or any property belonging to them while participating in any activity with Gali Studios.
Assumes full responsibility for any risks of loss, property damage, or personal injury, including death, which may be sustained by the participant as a result of being engaged in such activities.
The Client hereby releases, waives, and discharges Gali Studios, its owners, employees, contractors, and agents from any and all claims, liabilities, damages, or causes of action arising out of participation in the services, including claims resulting from ordinary negligence, to the fullest extent permitted by law.
Client Code of Conduct
To ensure a safe, respectful, and professional environment, all clients, guests, and visitors are expected to conduct themselves appropriately at all times while on Gali Studios premises or during any on-location services.
Respectful Behaviour
Clients and guests must treat all staff, other clients, and visitors with courtesy and respect and must follow all reasonable instructions provided by Gali Studios staff related to safety, operations, and studio guidelines.
Prohibited Conduct
The following behaviour will not be tolerated:
Aggressive, threatening, intimidating, or abusive behaviour
Harassment of any kind, including verbal, physical, or discriminatory conduct
Inappropriate language, gestures, or unwanted physical contact
Disruptive behaviour that compromises safety or the experience of others
Refusal to comply with reasonable safety or operational instructions
Right to End Services
Gali Studios reserves the right, at its sole discretion, to pause or immediately end any session and refuse service if a client or guest engages in unsafe, disruptive, or inappropriate behaviour.
Removal From Premises
If necessary, individuals may be required to leave the premises immediately. Failure to comply may result in law enforcement being contacted.
LATENESS:
Any Client that is late arriving to the session will have the amount of time late deducted from the time allotted for the session.
ARTISTIC RIGHTS:
2782425 ONTARIO INC. / Gali Studios retains the right of discretion in selecting the photographic materials released to the client.
Copyright and Reproductions:
2782425 ONTARIO INC. / Gali Studios shall own the copyright of all images created and shall have the exclusive right to make reproductions for, including but not limited to, marketing materials, portfolio entries, sample products, editorial submissions and use, or for display within or on the 2782425 ONTARIO INC. / Gali Studios website and/or studio.
Maximum Damages:
Client agrees that the maximum amount of damages he or she is entitled to in any claim relating to this Agreement or Services provided in this Agreement are not to exceed the Total Cost of Services provided by 2782425 ONTARIO INC. / Gali Studios. In any claim related to services provided, the maximum liability of Gali Studios shall not exceed the total amount paid by the Client.
Loss of Product:
In the event that any or all product(s) are lost, such as damage to or loss of a component of the product necessary for final delivery, 2782425 ONTARIO INC. / Gali Studios shall refund Client a pro-rated portion of the Total Cost based on the amount of Services that were completed/provided against the amount of Services that were agreed to be completed/provided. In the event of loss or damage to final deliverables, the Client’s sole remedy shall be a prorated refund based on services completed.
Security Monitoring Policy
The premises are under continuous video surveillance for the safety and security of all occupants, visitors, and property. By entering these premises, you consent to the audio/video recording and monitoring of all activities within the surveillance areas. These recordings may be used for security purposes, training and quality assurance purposes and may be disclosed to law enforcement or other authorized personnel as necessary. All recorded footage will be stored securely and managed in accordance with applicable privacy laws and regulations.
Governing Law:
The laws of Ontario, Canada govern all matters arising out of or relating to this Agreement, including torts.
Severability:
If any portion of this Agreement is deemed to be illegal or unenforceable, the remaining provisions of this Agreement remain in full force.
Promotions
Promotions cannot be doubled combined, transferred, or applied to within the same household. Limit One Promotional Session Per Family.
Rescheduling Policy
If you need to reschedule, please reach out to us at least 24 hours before your scheduled session. Once the 24-hour mark has passed, a $10 rescheduling fee will apply. This policy helps us manage our schedule effectively and provide the best service possible. Thank you for your cooperation.
Delivery
Final edited photos are delivered as digital downloads within 1 to 6 weeks, depending on the package selected. Our base package includes only a small preview gallery from which you can select your final images. This helps us keep the experience both affordable, maintain quality while keeping things budget-friendly. You understand and agree that selected photos from your session may be shared on our business platforms, including social media, website, marketing materials, online galleries, and promotional content.
Marketing Use Authorization
The Client grants Gali Studios the irrevocable right to use selected images from the session for marketing, promotional, portfolio, advertising, website, social media, and other business-related purposes, unless otherwise agreed to in writing prior to the session.
Withdrawal Requests
The Client may submit a written request for removal of specific images from marketing platforms. Gali Studios will make reasonable efforts to comply with such requests within a reasonable timeframe; however, removal is not guaranteed for materials already published, printed, distributed, or archived.
No Liability for Emotional Distress
The Client acknowledges that marketing use of images does not constitute grounds for claims of emotional distress, stress, anxiety, embarrassment, or reputational harm. The Client agrees that no claim shall arise from authorized use of images, even if the Client later experiences discomfort or changes their preferences.
No Admission of Liability
Any voluntary removal of images by Gali Studios shall not constitute an admission of fault, wrongdoing, or liability.
Emotional Distress and Non-Physical Damages
The Client acknowledges and agrees that Gali Studios shall not be liable for any claims related to emotional distress, mental anguish, stress, disappointment, anxiety, or subjective dissatisfaction arising from the services provided, including but not limited to the photography experience, artistic style, interpersonal interactions, scheduling changes, or final deliverables.
The Client further agrees that no claim shall be made for non-physical, indirect, incidental, or consequential damages. Any claim relating to this Agreement shall be limited in accordance with the Maximum Damages section of this Agreement.
